The Measures of the People's Republic of China for the Administration of Import and ExportFood Safety, which were deliberated and adopted at the executive meeting of the General Administration of Customs on April 12, 2021, are hereby promulgated, and shall come into forceas of January 1, 2022. 

《中華人民共和國進(jìn)出口食品安全管理辦法》(以下簡稱《辦法》)經(jīng)海關(guān)總署署務(wù)會議審議通過后于 2021 年 4 月 12 日公布,自 2022 年 1 月 1 日起實(shí)施。


The Measures for the Administration of Import and Export Food Safety promulgated in the form of Decree No. 144 by the former General Administration of Quality Supervision, Inspection and Quarantine on September 13, 2011and amended in accordance with Decree No. 184 of the former General Administration of Quality Supervision, Inspection and Quarantine on October 18, 2016 and Decree No. 243 of the General Administration of Customs on November 23, 2018,

The Measures of the People's Republic of China for the Administration of Import and Export Food Safety


第一章 總則

Chapter I General Provisions


第一條 為了保障進(jìn)出口食品安全,保護(hù)人類、動植物生命和健康,根據(jù)《中華人民共和國食品安全法》(以下簡稱《食品安全法》)及其實(shí)施條例、《中華人民共和國海關(guān)法》《中華人民共和國進(jìn)出口商品檢驗(yàn)法》及其實(shí)施條例、《中華人民共和國進(jìn)出境動植物檢疫法》及其實(shí)施條例、《中華人民共和國國境衛(wèi)生檢疫法》及其實(shí)施細(xì)則、《中華人民共和國農(nóng)產(chǎn)品質(zhì)量安全法》和《國務(wù)院關(guān)于加強(qiáng)食品等產(chǎn)品安全監(jiān)督管理的特別規(guī)定》等法律、行政法規(guī)的規(guī)定,制定本辦法。


Article 1 For the purposes of ensuring the safety of import and export food and protecting the life and health of human beings, animals, and plants, these Measures are formulated in accordance with such laws and administrative rules or regulations as Food Safety Law of the People's Republic of China (hereinafter referred to as the Food Safety Law) and its implementation regulations, the Customs Law of the People's Republic of China, the Law of the People’s Republic of China on Import and Export Commodity Inspection and its implementation regulations, the Law of the People's Republic of China on Entry and Exit Animal and Plant Quarantine and its implementation regulations, the Frontier Health and Quarantine Law of the People's Republic of China and its implementation details, the Agricultural Product Quality Safety Law of the People's Republic of China, the Special Rules of the State Council on Strengthening the Supervision and Management of the Safety of Food and Other Products.


第二條 從事下列活動,應(yīng)當(dāng)遵守本辦法:

(一)進(jìn)出口食品生產(chǎn)經(jīng)營活動;(二)海關(guān)對進(jìn)出口食品生產(chǎn)經(jīng)營者及其進(jìn)出口食品安全實(shí)施監(jiān)督管理。進(jìn)出口食品添加劑、食品相關(guān)產(chǎn)品的生產(chǎn)經(jīng)營活動按照海關(guān)總署相關(guān)規(guī)定執(zhí)行。

Article 2 The following activities shall be conducted in compliance with these Measures:

(I) Import and export food production and operation activities.

(II) The Customs Administration shall implement supervision and administration on import and export food producers and operators and the safety of their import and export food.The production and operation activities of import and export food additives and food-related products shall be subject to the relevant rules of the General Administration of Customs.


第三條 進(jìn)出口食品安全工作堅(jiān)持安全第一、預(yù)防為主、風(fēng)險(xiǎn)管理、全程控制、國際共治的原則。

Article 3 Regarding the safety of import and export food, the principles of safety first,prevention crucial, risk management, whole process control, and international co-governance shall be followed.


第四條 進(jìn)出口食品生產(chǎn)經(jīng)營者對其生產(chǎn)經(jīng)營的進(jìn)出口食品安全負(fù)責(zé)。進(jìn)出口食品生產(chǎn)經(jīng)營者應(yīng)當(dāng)依照中國締結(jié)或者參加的國際條約、協(xié)定,中國法律法規(guī)和食品安全國家標(biāo)準(zhǔn)從事進(jìn)出口食品生產(chǎn)經(jīng)營活動,依法接受監(jiān)督管理,保證進(jìn)出口食品安全,對社會和公眾負(fù)責(zé),承擔(dān)社會責(zé)任。

Article 4 Import and export food producers and operators shall be responsible for the safety of the import and export food they produce and manage. Import and export food producers and operators shall undertake import and export food production and operation activities in accordance with any international treaty or agreement entered into or acceded to by China and the laws, regulations, national food safety standards of China, accept supervision and administration in cordance with the law, ensure the import and export food safety, be responsible for the society and the public, and assume social responsibility.


第五條 海關(guān)總署主管全國進(jìn)出口食品安全監(jiān)督管理工作。各級海關(guān)負(fù)責(zé)所轄區(qū)域進(jìn)出口食品安全監(jiān)督管理工作。

Article 5 The General Administration of Customs shall take principal charge of supervision and administration on import and export food safety throughout the country. The Customs Administrations at all levels shall be responsible for the supervision and administration of import and export food safety within their espective jurisdictions.


第六條 海關(guān)運(yùn)用信息化手段提升進(jìn)出口食品安全監(jiān)督管理水平。

Article 6 The Customs Administration shall use informatization technology to update the supervision and administration level of import and export food safety.


第七條 海關(guān)加強(qiáng)進(jìn)出口食品安全的宣傳教育,開展食品安全法律、行政法規(guī)以及食品安全國家標(biāo)準(zhǔn)和知識的普及工作。

海關(guān)加強(qiáng)與食品安全國際組織、境外政府機(jī)構(gòu)、境外食品行業(yè)協(xié)會、境外消費(fèi)者協(xié)會等交流與合作,營造進(jìn)出口食品安全國際共治格局。

Article 7 The Customs Administration shall step up publicity and education about the import and export food safety, and disseminate food safety laws, dministrative regulations, and national standards and knowledge on food safety. The Customs Administration shall strengthen exchanges and cooperation with international food safety organizations, overseas government agencies, overseas food industry associations, and overseas consumer associations, among others, to create an international co-governance pattern for the import and export food safety.


第八條 海關(guān)從事進(jìn)出口食品安全監(jiān)督管理的人員應(yīng)當(dāng)具備相關(guān)專業(yè)知識。

Article 8 The Customs Administration personnel engaged in the supervision and administration on import and export food safety shall possess relevant professional knowledge.


第二章 食品進(jìn)口

Chapter II Food Import 


第九條 進(jìn)口食品應(yīng)當(dāng)符合中國法律法規(guī)和食品安全國家標(biāo)準(zhǔn),中國締結(jié)或者參加的國際條約、協(xié)定有特殊要求的,還應(yīng)當(dāng)符合國際條約、協(xié)定的要求。進(jìn)口尚無食品安全國家標(biāo)準(zhǔn)的食品,應(yīng)當(dāng)符合國務(wù)院衛(wèi)生行政部門公布的暫予適用的相關(guān)標(biāo)準(zhǔn)要求。

Article 9 Imported food shall comply with the laws, regulations, and national food safety standards of China and the special requirements of any international treaty or agreement entered into or acceded to by China. The imported food, for which the national food safety standards are unavailable, shall comply with the requirements of the relevant interim applicable standards promulgated by the health authority of the State Council. For food produced with new food raw aterials, a health administrative permit for new food raw materials shall be obtained from the health authority of the State Council in accordance with provisions specified in Article 37 of the Food Safety Law.


第十條 海關(guān)依據(jù)進(jìn)出口商品檢驗(yàn)相關(guān)法律、行政法規(guī)的規(guī)定對進(jìn)口食品實(shí)施合格評定。

進(jìn)口食品合格評定活動包括:向中國境內(nèi)出口食品的境外國家(地區(qū))〔以下簡稱境外國家(地區(qū))〕食品安全管理體系評估和審查、境外生產(chǎn)企業(yè)注冊、進(jìn)出口商備案和合格保證、進(jìn)境動植物檢疫審批、隨附合格證明檢查、單證審核、現(xiàn)場查驗(yàn)、監(jiān) 督抽檢、進(jìn)口和銷售記錄檢查以及各項(xiàng)的組合。

Article 10 The Customs Administration shall implement conformity assessment on import food in accordance with the laws and administrative regulations on the inspection of import and export goods.

Import food conformity assessment activities include the assessment and examination of the food safety management system of a foreign country (region) exporting food to China (hereinafter simply referred to as a foreign country (region)), the registration of an overseas roduction

enterprise, the importer and exporter record and conformity guarantee, the quarantine approval of imported animals and plants, the inspection of an ccompanying certificate of conformity, the verification of documentation, on-site inspection, supervisory sampling inspection, the inspection of import and sales records, and a combination of all the miscellaneous items.


第十一條 海關(guān)總署可以對境外國家(地區(qū))的食品安全管理體系和食品安全狀況開展評估和審查,并根據(jù)評估和審查結(jié)果,確定相應(yīng)的檢驗(yàn)檢疫要求。

Article 11 The General Administration of Customs may assess and examine the food safety management system and food safety status of a foreign country (region), and determine corresponding inspection and quarantine requirements based on the results of the assessment and examination.


第十二條 有下列情形之一的,海關(guān)總署可以對境外國家(地區(qū))啟動評估和審查:

Article 12 Under any of the following circumstances, the General Administration of Customs may initiate an assessment and examination on a foreign country (region):

(一)境外國家(地區(qū))申請向中國首次輸出某類(種)食品的;

(I) 境外國家(地區(qū))申請向中國首次輸出某類(種)食品的;

   A foreign country (region) applies for the export of a class or kind of food to China for the first time;

(II) 境外國家(地區(qū))食品安全、動植物檢疫法律法規(guī)、組織機(jī)構(gòu)等發(fā)生重大調(diào)整的 

   A significant adjustment occurs to the food safety, animal and plant quarantine laws and regulations, or organizational structure, among others, of the foreign country (region);

(III) 境外國家(地區(qū))主管部門申請對其輸往中國某類(種)食品的檢驗(yàn)檢疫要求發(fā)生重大調(diào)整的

   A significant adjustment occurs to the inspection and quarantine requirements for a certain class or kind of food applied for by the competent authority of a foreign country (region) with China as its destination;

(IV) 境外國家(地區(qū))發(fā)生重大動植物疫情或者食品安全事件的;

   A significant outbreak of animal or plant diseases or food safety incidents occur in a foreign country (region);

(V) 海關(guān)在輸華食品中發(fā)現(xiàn)嚴(yán)重問題,認(rèn)為存在動植物疫情或者食品安全隱患的;

   The Customs Administration discovers a serious problem in the food imported to China and holds that there is an outbreak of animal or plant diseases or a potential food safety risk;

(VI) 其他需要開展評估和審查的情形

Other circumstances necessary for an assessment and examination.


第十三條 境外國家(地區(qū))食品安全管理體系評估和審查主要包括對以下內(nèi)容的評估、確認(rèn):

Article 13 An assessment and examination on the food safety management system of a foreign country (region) shall mainly include the assessment and confirmation of the followings:

(I) 食品安全、動植物檢疫相關(guān)法律法規(guī);

Laws and regulations related to food safety and animal and plant quarantine;

(II) 食品安全監(jiān)督管理組織機(jī)構(gòu)

The organizational structure for supervision and administration on food safety;

(III) 動植物疫情流行情況及防控措施

The prevailing animal or plant diseases and prevention and control measures;

(IV) 致病微生物、農(nóng)獸藥和污染物等管理和控

The management and control of pathogenic microorganisms, pesticides and veterinary drugs, and contaminants, among others;

(V) 食品生產(chǎn)加工、運(yùn)輸倉儲環(huán)節(jié)安全衛(wèi)生控制;

Safety and health control in the procedures of food production, processing, transportation,and warehousing;

(VI) 出口食品安全監(jiān)督管理

Supervision and administration on export food safety;

(VII)食品安全防護(hù)、追溯和召回體系

 Food safety protection, traceability and recall system;

(VIII)預(yù)警和應(yīng)急機(jī)制

 Early warning and emergency response mechanism;

(IX) 技術(shù)支撐能力

Technical support capabilities;

(X) 其他涉及動植物疫情、食品安全的情況

Others relating to the prevailing animal or plant diseases and food safety;


第十四條 海關(guān)總署可以組織專家通過資料審查、視頻檢查、現(xiàn)場檢查等形式及其組合,實(shí)施評估和審查。

Article 14 The General Administration of Customs may arrange for experts to conduct an assessment and examination in the form of material examinations, video inspection, and on-site inspection, among others, or in such a combination.


第十五條 海關(guān)總署組織專家對接受評估和審查的國家(地區(qū))遞交的申請資料、書面評估問卷等資料實(shí)施審查,審查內(nèi)容包括資料的真實(shí)性、完整性和有效性。根據(jù)資料審查情況,海關(guān)總署可以要求相關(guān)國家(地區(qū))的主管部門補(bǔ)充缺少的信息或者資料。

Article 15 The General Administration of Customs shall arrange for experts to examine the application materials, written assessment questionnaires, and other materials submitted by a country (region) subject to assessment and examination, and the examination involved covers the  materials’ authenticity, completeness and validity. Based on the examination of materials, the General Administration of Customs may require the competent authority of the relevant country (region) to provide the missing information or documents.


對已通過資料審查的國家(地區(qū)),海關(guān)總署可以組織專家對其食品安全管理體系實(shí)施視頻檢查或者現(xiàn)場檢查。對發(fā)現(xiàn)的問題可以要求相關(guān)國家(地區(qū))主管部門及相關(guān)企業(yè)實(shí)施整改。相關(guān)國家(地區(qū))應(yīng)當(dāng)為評估和審查提供必要的協(xié)助。

 If a country (region) has passed the examination of materials, the General Administration of Customs may arrange for experts to conduct a video inspection or an on-site inspection on its food  safety management system. The competent authority of the relevant country (region) and relevant enterprises may be required to take corrective actions on any problems discovered. The relevant country (region) shall provide necessary assistance for assessment and examination.


Article 16 接受評估和審查的國家(地區(qū))有下列情形之一,海關(guān)總署可以終止評估和審查,并通知相關(guān)國家(地區(qū))主管部門:

 Where a country (region) subject to assessment and examination falls under any of the following circumstances, the General Administration of Customs may terminate the assessment and examination, and notify the competent authority of the relevant country (region):

(I) 收到書面評估問卷12 個月內(nèi)未反饋

Failing to provide a feedback within 12 months after receiving the written assessment questionnaire;

(II) 收到海關(guān)總署補(bǔ)充信息和材料的通知3 個月內(nèi)未按要求提供的;

Failing to provide supplemented information and materials as required within three months after receiving a notice from the General Administration of Customs;

(III) 突發(fā)重大動植物疫情或者重大食品安全事件的;

A sudden significant outbreak of animal or plant disease or a serious food safety incident;

(IV) 未能配合中方完成視頻檢查或者現(xiàn)場檢查、未能有效完成整改的;

Failing to cooperate with the Chinese side in completing a video inspection or on-site inspection, or failing to effectively complete corrective actions; 

(V) 主動申請終止評估和審查的. 前款第一、二項(xiàng)情形,相關(guān)國家(地區(qū))主管部門因特殊原因可以申請延期,經(jīng)海關(guān)總署同意,按照海關(guān)總署重新確定的期限遞交相關(guān)材料。

Voluntarily applying for termination of the assessment and examination. Under any circumstances in subparagraphs (I) and (II) of the preceding paragraph, the

competent authority of the relevant country (region), on account of a special reason, may apply for deferral, and, upon consent by the General Administration of Customs, submit the relevant materials within a period determined a new by the General Administration of Customs.


第十七條 評估和審查完成后,海關(guān)總署向接受評估和審查的國家(地區(qū))主管部門通報(bào)評估和審查結(jié)果。

Article 17 After completion of an assessment and examination, the General Administration of Customs shall notify the competent authority of a country (region) subject to assessment and examination of the assessment and examination results. 


第十八條 海關(guān)總署對向中國境內(nèi)出口食品的境外生產(chǎn)企業(yè)實(shí)施注冊管理,并公布獲得注冊的企業(yè)名單。

Article 18 The General Administration of Customs shall exercise registration administration on overseas production enterprises that export food to China, and promulgate a name list of enterprises that have been registered.


第十九條 向中國境內(nèi)出口食品的境外出口商或者代理商(以下簡稱“境外出口商或者代理商”)應(yīng)當(dāng)向海關(guān)總署備案。食品進(jìn)口商應(yīng)當(dāng)向其住所地海關(guān)備案。境外出口商或者代理商、食品進(jìn)口商辦理備案時,應(yīng)當(dāng)對其提供資料的真實(shí)性、有效性負(fù)責(zé)。境外出口商或者代理商、食品進(jìn)口商備案名單由海關(guān)總署公布。

Article 19 An overseas exporter or agent that exports food to China (hereinafter referred to as the "overseas exporter or agent") shall make a filing with the General Administration of Customs. A food importer shall make a filing with the Customs Administration in the place of his or her domicile. An overseas exporter or agent, or food importer shall be responsible for the truthfulness and validity of the materials provided when making a filing. A list of overseas exporters or agents and food importers that have made a filing shall be published by the General Administration of Customs.


第二十條 境外出口商或者代理商、食品進(jìn)口商備案內(nèi)容發(fā)生變更的,應(yīng)當(dāng)在變更發(fā)生之日起60 日內(nèi),向備案機(jī)關(guān)辦理變更手續(xù)。海關(guān)發(fā)現(xiàn)境外出口商或者代理商、食品進(jìn)口商備案信息錯誤或者備案內(nèi)容未及時變更的,可以責(zé)令其在規(guī)定期限內(nèi)更正。

Article 20 Where there is a change in the content of the filing, the overseas exporter or agent or food importer shall process the modification formalities with the filing authorities within 60 days from the change date. Where the information filed by an overseas exporter or agent, or a food importer is found to be erroneous, or the content of his or her filing fails to be modified in a timely manner, the Customs Administration may order him or her to make corrections within a specified period.


第二十一條 食品進(jìn)口商應(yīng)當(dāng)建立食品進(jìn)口和銷售記錄制度,

如實(shí)記錄食品名稱、凈含量/規(guī)格、數(shù)量、生產(chǎn)日期、生產(chǎn)或者進(jìn)口批號、保質(zhì)期、境外出口商和購貨者名稱、地址及聯(lián)系方式、交貨日期等內(nèi)容,并保存相關(guān)憑證。記錄和憑證保存期限不得少于食品保質(zhì)期滿后6 個月;沒有明確保質(zhì)期的,保存期限為銷售后2 年以上。

Article 21 A food importer shall establish a food import and sales record system, truthfully record the name, net content/specification, quantity, production date, production or import lot number, shelf life, the name, address, and contact information of the overseas exporter or purchaser, delivery date, and other information on food, and keep relevant documents. The records and documents shall be kept for not less than six months after the expiration of shelf life of food, or for not less than two years after sale in the absence of such shelf life.


第二十二條 食品進(jìn)口商應(yīng)當(dāng)建立境外出口商、境外生產(chǎn)企業(yè)審核制度,重點(diǎn)審核下列內(nèi)容:

Article 22 A food importer shall establish an overseas exporters and overseas production enterprises audit system with a focus on examining the following:

(一)制定和執(zhí)行食品安全風(fēng)險(xiǎn)控制措施情況;

(二)保證食品符合中國法律法規(guī)和食品安全國家標(biāo)準(zhǔn)的情況。

(I) Formulation and implementations of food safety risk control measures;

(II) Ensurance that the food complies with the laws, regulations, and national food safety standards of China;


第二十三條 海關(guān)依法對食品進(jìn)口商實(shí)施審核活動的情況進(jìn)行監(jiān)督檢查。食品進(jìn)口商應(yīng)當(dāng)積極配合,如實(shí)提供相關(guān)情況和料。

Article 23 The Customs Administration shall conduct supervisory inspections on the examination activities conducted by food importers in accordance with the law. A food importer shall actively cooperate and truthfully provide relevant information and materials. 


第二十四條 海關(guān)可以根據(jù)風(fēng)險(xiǎn)管理需要,對進(jìn)口食品實(shí)施指定口岸進(jìn)口,指定監(jiān)管場地檢查。指定口岸、指定監(jiān)管場地名單由海關(guān)總署公布。

Article 24 The Customs Administration may, as needed for risk management, designate a port for import and a supervision zone for inspection with respect to import food. A list of designated ports and designated supervision zones shall be promulgated by the General Administration of Customs.


第二十五條 食品進(jìn)口商或者其代理人進(jìn)口食品時應(yīng)當(dāng)依法向海關(guān)如實(shí)申報(bào)。

Article 25 A food importer or his or her agent shall, in accordance with the law, truthfully make a declaration to the Customs Administration when importing food.


第二十六條 海關(guān)依法對應(yīng)當(dāng)實(shí)施入境檢疫的進(jìn)口食品實(shí)施檢疫。

Article 26 The Customs Administration shall, in accordance with the law, implement quarantine inspection on the import food subject to entry quarantine.


第二十七條 海關(guān)依法對需要進(jìn)境動植物檢疫審批的進(jìn)口食品實(shí)施檢疫審批管理。食品進(jìn)口商應(yīng)當(dāng)在簽訂貿(mào)易合同或者協(xié)議前取得進(jìn)境動植物檢疫許可。

Article 27 The Customs Administration shall, in accordance with the law, exercise quarantine approval management of the import food subject to imported animal and plant quarantine approval . A food importer shall obtain an imported animal and plant quarantine permit before signing a trade contract or agreement.


第二十八條 海關(guān)根據(jù)監(jiān)督管理需要,對進(jìn)口食品實(shí)施現(xiàn)場查驗(yàn),現(xiàn)場查驗(yàn)包括但不限于以下內(nèi)容:

(一)運(yùn)輸工具、存放場所是否符合安全衛(wèi)生要求;(二)集裝箱號、封識號、內(nèi)外包裝上的標(biāo)識內(nèi)容、貨物的實(shí)際狀況是否與申報(bào)信息及隨附單證相符;

Article 28 The Customs Administration shall, as needed for supervision and administration, conduct an on-site inspection on the import food, which includes but is not limited to the following:

(I) Whether the means of transportation and storage areas meet the safety and health requirements;

(II) Whether the container number, seal identification number, the content of the marks on the inner and outer packaging, and the actual condition of the goods are consistent with the declared information and accompanying documentation;

(三)動植物源性食品、包裝物及鋪墊材料是否存在《進(jìn)出境動植物檢疫法實(shí)施條例》第二十二條規(guī)定的情況;

(四)內(nèi)外包裝是否符合食品安全國家標(biāo)準(zhǔn),是否存在污染、 破損、濕浸、滲透;

(五)內(nèi)外包裝的標(biāo)簽、標(biāo)識及說明書是否符合法律、行政法規(guī)、食品安全國家標(biāo)準(zhǔn)以及海關(guān)總署規(guī)定的要求;

(六)食品感官性狀是否符合該食品應(yīng)有性狀;

(七)冷凍冷藏食品的新鮮程度、中心溫度是否符合要求、是否有病變、冷凍冷藏環(huán)境溫度是否符合相關(guān)標(biāo)準(zhǔn)要求、冷鏈控溫設(shè)備設(shè)施運(yùn)作是否正常、溫度記錄是否符合要求,必要時可以進(jìn)行蒸煮試驗(yàn)。

(III) Whether the food of animal and plant origin, packaging, and dunnage materials fall under the circumstances specified in Article 22 of the Regulations on the Implementation of the Law on Quarantining Imported and Exported Animals and Plants;

(IV) Whether inner and outer packaging complies with the national food safety standards, and whether contamination, damage, soak, or leakage exists;

(V) Whether the labels, marks and instructions on inner and outer packaging meet the requirements of laws, administrative regulations, national food safety standards, and the rules of the General Administration of Customs;

(VI) Whether the perceivable status of food is in its expected condition;

(VII) Whether the freshness and core temperature of frozen and refrigerated food meet the requirements, whether there is a disease, whether the temperature of the freezing and refrigeration environment meets the requirements of relevant standards, whether the cold chain temperature control equipment and facility function normally, and whether temperature records meet the requirements. A steaming and cooking test may be conducted when necessary.


第二十九條 海關(guān)制定年度國家進(jìn)口食品安全監(jiān)督抽檢計(jì)劃和專項(xiàng)進(jìn)口食品安全監(jiān)督抽檢計(jì)劃,并組織實(shí)施。

Article 29 The Customs Administration shall formulate an annual national import food safety supervisory sampling inspection plan and a special import food safety supervisory sampling inspection plan and organize their implementation.


第三十條 進(jìn)口食品的包裝和標(biāo)簽、標(biāo)識應(yīng)當(dāng)符合中國法律法規(guī)和食品安全國家標(biāo)準(zhǔn);依法應(yīng)當(dāng)有說明書的,還應(yīng)當(dāng)有中文說明書。

對于進(jìn)口鮮凍肉類產(chǎn)品,內(nèi)外包裝上應(yīng)當(dāng)有牢固、清晰、易辨的中英文或者中文和出口國家(地區(qū))文字標(biāo)識,標(biāo)明以下內(nèi)容:產(chǎn)地國家(地區(qū))、品名、生產(chǎn)企業(yè)注冊編號、生產(chǎn)批號;外包裝上應(yīng)當(dāng)以中文標(biāo)明規(guī)格、產(chǎn)地(具體到州/省/市)、目的地、生產(chǎn)日期、保質(zhì)期限、儲存溫度等內(nèi)容,必須標(biāo)注目的地為中華人民共和國,加施出口國家(地區(qū))官方檢驗(yàn)檢疫標(biāo)識。

Article 30 The packagings, labels, and marks of import food shall comply with the laws, regulations, national food safety standards of China, and shall be accompanied by an instruction manual in Chinese if the law so requires. 

For an imported cold fresh meat product, its inner and outer packaging shall bear a secure clear, and legible written identification in both Chinese and English, or in Chinese and the language of the export country (region), indicating the following: 

country or region of origin, name of the product, registration number of the production enterprise, and production lot number; and the outer packaging shall bear the specifications, place of origin (specific to state, province, or city), place of destination, production date, shelf life, storage temperature, and other information in Chinese, and must indicate that the place of destination is the People's Republic of China, and carry the official inspection and quarantine mark of the export country (region) .

For an imported aquatic product, its inner and outer packaging shall bear a secure, clear, and legible written identification in both Chinese and English, or in Chinese and the language of the export country (region), indicating the following: name of the goods and scientific name,specifications, production date, lot number, shelf life, and storage conditions, production method (seawater fishing, freshwater fishing, or aquaculture), production area (sea area in the case of ocean fishing, country (region) in the case of freshwater fishing, or country (region) where the aquaculture product originates), the name, registration number, and address (specific to state, province, or city) of each production or processing enterprise involved (including a fishing vessel, processing vessel, transport vessel, or an independent cold store), and the place of destination must be indicated as the People's Republic of China. The label of an imported dietary supplement or food for special dietary use in Chinese must be printed on the smallest sales package, and shall not be affixed thereto. The relevant provisions or stipulations shall be followed if there are any special .labelling stipulations for the inner and outer packaging of import food.

對于進(jìn)口水產(chǎn)品,內(nèi)外包裝上應(yīng)當(dāng)有牢固、清晰、易辨的中英文或者中文和出口國家(地區(qū))文字標(biāo)識,標(biāo)明以下內(nèi)容:商品名和學(xué)名、規(guī)格、生產(chǎn)日期、批號、保質(zhì)期限和保存條件、生產(chǎn)方式(海水捕撈、淡水捕撈、養(yǎng)殖)、生產(chǎn)地區(qū)(海洋捕撈海域、淡水捕撈國家或者地區(qū)、養(yǎng)殖產(chǎn)品所在國家或者地區(qū))、涉及的所有生產(chǎn)加工企業(yè)(含捕撈船、加工船、運(yùn)輸船、獨(dú)立冷庫)名稱、注冊編號及地址(具體到州/省/市)、必須標(biāo)注目的地為中華人民共和國。進(jìn)口保健食品、特殊膳食用食品的中文標(biāo)簽必須印制在最小銷售包裝上,不得加貼。

進(jìn)口食品內(nèi)外包裝有特殊標(biāo)識規(guī)定的,按照相關(guān)規(guī)定執(zhí)行。


第三十一條 進(jìn)口食品運(yùn)達(dá)口岸后,應(yīng)當(dāng)存放在海關(guān)指定或者認(rèn)可的場所;需要移動的,必須經(jīng)海關(guān)允許,并按照海關(guān)要求采取必要的安全防護(hù)措施

。Article 31 Import food, after delivery to a port, should be stored in the places designated or approved by the Customs Administration. Permission must be obtained from the Customs Administration if such food needs moving, and necessary safety protection measures shall be taken according to the requirements of the Customs Administration. The places designated or approved should comply with the requirements stipulated in laws, administrative regulations and national food safety standards.


第三十二條 大宗散裝進(jìn)口食品應(yīng)當(dāng)按照海關(guān)要求在卸貨口岸進(jìn)行檢驗(yàn)

Article 32 Import food in bulk should be inspected at the port of discharge according to requirements of the Customs Administration.


第三十三條 進(jìn)口食品經(jīng)海關(guān)合格評定合格的,準(zhǔn)予進(jìn)口。

進(jìn)口食品經(jīng)海關(guān)合格評定不合格的,由海關(guān)出具不合格證明;涉及安全、健康、環(huán)境保護(hù)項(xiàng)目不合格的,由海關(guān)書面通知食品進(jìn)口商,責(zé)令其銷毀或者退運(yùn);其他項(xiàng)目不合格的,經(jīng)技術(shù)處理符合合格評定要求的,方準(zhǔn)進(jìn)口。相關(guān)進(jìn)口食品不能在規(guī)定時間內(nèi)完成技術(shù)處理或者經(jīng)技術(shù)處理仍不合格的,由海關(guān)責(zé)令食品進(jìn)口商銷毀或者退運(yùn)。

Article 33 Import food shall be permitted to import upon passing the conformity assessment by the Customs Administration. The Customs Administration shall issue a certificate of non-conformity for the import food failing the conformity assessment by the Customs Administration; for the foods of non-conformity involving safety, health and environmental protection, the Customs Administration shall send a written notice to a food importer and order him or her to destruct or return the food involved. 

For non-conformity of other items, the food shall be permitted to import after having met the requirements stipulated in conformity assessment by means of technical treatment. For the corresponding import food that fails such technical treatment within a prescribed time period or still fails to meet the relevant requirements after the technical treatment , the Customs Administration shall order the food importer to destruct or return the food involved.


第三十四條 境外發(fā)生食品安全事件可能導(dǎo)致中國境內(nèi)食品安全隱患,或者海關(guān)實(shí)施進(jìn)口食品監(jiān)督管理過程中發(fā)現(xiàn)不合格進(jìn)口食品,或者發(fā)現(xiàn)其他食品安全問題的,海關(guān)總署和經(jīng)授權(quán)的

直屬海關(guān)可以依據(jù)風(fēng)險(xiǎn)評估結(jié)果對相關(guān)進(jìn)口食品實(shí)施提高監(jiān)督抽檢比例等控制措施。

Article 34 In case of any foods with potential safety hazards within the territory of China caused by food safety incidents in foreign countries, or the import food found to be disqualified during the food supervision and management by the Customs Administration, or other issues related to food safety discovered, General Administration of Customs and its authorized Customs directly under the General Administration, may, based on the results of risk assessment, take such control measures as increasing the proportion for supervision and sampling inspecion on the relevant import food.

海關(guān)依照前款規(guī)定對進(jìn)口食品采取提高監(jiān)督抽檢比例等控制措施后,再次發(fā)現(xiàn)不合格進(jìn)口食品,或者有證據(jù)顯示進(jìn)口食品存在重大安全隱患的,海關(guān)總署和經(jīng)授權(quán)的直屬海關(guān)可以要求食

品進(jìn)口商逐批向海關(guān)提交有資質(zhì)的檢驗(yàn)機(jī)構(gòu)出具的檢驗(yàn)報(bào)告。海關(guān)應(yīng)當(dāng)對食品進(jìn)口商提供的檢驗(yàn)報(bào)告進(jìn)行驗(yàn)核。

For the import food found to be non-conforming again by the Customs Administration after taking such control measures as increasing the proportion for supervision and sampling inspection on the relevant import food as prescribed above, or certain evidences showing the significant potential safety hazard in the import food, General Administration of Customs and its authorized Customs directly under the General Administration, may request the food importer to provide, by batches, the Customs Administration with inspection reports issued by the accredited test agency. The Customs Administration should verify such inspection reports submitted by the food importer. 


第三十五條 有下列情形之一的,海關(guān)總署依據(jù)風(fēng)險(xiǎn)評估結(jié)果,可以對相關(guān)食品采取暫?;蛘呓惯M(jìn)口的控制措施:

(一)出口國家(地區(qū))發(fā)生重大動植物疫情,或者食品安全體系發(fā)生重大變化,無法有效保證輸華食品安全的;

(二)進(jìn)口食品被檢疫傳染病病原體污染,或者有證據(jù)表明能夠成為檢疫傳染病傳播媒介,且無法實(shí)施有效衛(wèi)生處理的;

(三)海關(guān)實(shí)施本辦法第三十四條第二款規(guī)定控制措施的進(jìn)口食品,再次發(fā)現(xiàn)相關(guān)安全、健康、環(huán)境保護(hù)項(xiàng)目不合格的;

(四)境外生產(chǎn)企業(yè)違反中國相關(guān)法律法規(guī),情節(jié)嚴(yán)重的;

Article 35 General Administration of Customs may, based on the results of risk assessment, adopt such control measures as suspending or prohibiting the import of relevant food in any of the following cases:

(I) Exporting country (region) is subject to a significant epidemic in flora and fauna, or to a significant change in food safety system, which affects its capability to effectively guarantee the safety of food exported to China;

(II) Imported food is contaminated by pathogens of epidemic or evidenced to be capable of becoming the media of spreading such epidemics, with no possibilities of taking effective sanitary treatment;

(III) The imported food for which the control measures specified in the second paragraph of Article 34 in these Measures have been implemented by the Customs Administration is discovered again to be non-conforming in such aspects as safety, health and environmental protection;

(IV) Foreign food producers are in serious violation of Chinese laws and regulations;

(V) Other information shows the significant potential safety hazards in relevant food. 


第三十六條 進(jìn)口食品安全風(fēng)險(xiǎn)已降低到可控水平時,海關(guān)總署和經(jīng)授權(quán)的直屬海關(guān)可以按照以下方式解除相應(yīng)控制措施:

Article 36 When the import food safety risks have been lowered to a controllable level, General Administration of Customs and its authorized Customs directly under the General Administration, may lift the corresponding control measures in the following ways:

(一)實(shí)施本辦法第三十四條第一款控制措施的食品,在規(guī)定的時間、批次內(nèi)未被發(fā)現(xiàn)不合格的,在風(fēng)險(xiǎn)評估基礎(chǔ)上可以解除該控制措施;

(I) For the food with control measures taken according to the first paragraph of Article 34 of these Measures and for which no more non-conformity is found within a prescribed time period and in relevant batches, the control measures may be lifted on the basis of risk assessment;

(二)實(shí)施本辦法第三十四條第二款控制措施的食品,出口國家(地區(qū))已采取預(yù)防措施,經(jīng)海關(guān)總署風(fēng)險(xiǎn)評估能夠保障食品安全、控制動植物疫情風(fēng)險(xiǎn),或者從實(shí)施該控制措施之日起在

規(guī)定時間、批次內(nèi)未發(fā)現(xiàn)不合格食品的,海關(guān)在風(fēng)險(xiǎn)評估基礎(chǔ)上可以解除該控制措施;

(II) For the food with control measures taken according to the second paragraph of Article 34 of these Measures, for which the exporting country (region) has already taken preventive measures and is capable of ensuring the food safety and controlling the risks in epidemics in flora and fauna after the risk assessment by General Administration of Customs, or no more non-conformity is found within a prescribed time period and in relevant batches from the date of the relevant control measures taken, the Customs Administration may lift the control measures on the basis of risk assessment;

(二)實(shí)施本辦法第三十四條第二款控制措施的食品,出口國家(地區(qū))已采取預(yù)防措施,經(jīng)海關(guān)總署風(fēng)險(xiǎn)評估能夠保障食品安全、控制動植物疫情風(fēng)險(xiǎn),或者從實(shí)施該控制措施之日起在

規(guī)定時間、批次內(nèi)未發(fā)現(xiàn)不合格食品的,海關(guān)在風(fēng)險(xiǎn)評估基礎(chǔ)上可以解除該控制措施;

(III) For the food under control measures suspended or prohibited from the import, for which the competent authorities in the exporting country (region) have already taken risk control measures and have met the requirements after assessment by General Administration of Customs, such measures of suspending or prohibiting the import may be lifted. For the food permitted to be imported again, General Administration of Customs may, based on the results of assessment, take the control measures prescribed in Article 34 of these Measures.


第三十七條 食品進(jìn)口商發(fā)現(xiàn)進(jìn)口食品不符合法律、行政法規(guī)和食品安全國家標(biāo)準(zhǔn),或者有證據(jù)證明可能危害人體健康,應(yīng)當(dāng)按照《食品安全法》第六十三條和第九十四條第三款規(guī)定,

立即停止進(jìn)口、銷售和使用,實(shí)施召回,通知相關(guān)生產(chǎn)經(jīng)營者和消費(fèi)者,記錄召回和通知情況,并將食品召回、通知和處理情況向所在地海關(guān)報(bào)告

Article 37 Upon discovering that the import food fails to comply with laws, administrative regulations and national food safety standards, or there are evidences proving that the import food poses potential hazards to human health, food importers should, based on Article 63 and the third paragraph of Article 94 of the Food Safety Law, immediately suspend the import, sales and use, implement a recall, give a notice to relevant food producers, operators and consumers, record the processes of recall and notice, and file a report to the local Customs Administration about such recall, notice and response.


第三章 食品出口 Chapter III Food Export  


第三十八條 出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)保證其出口食品符合進(jìn)口國家(地區(qū))的標(biāo)準(zhǔn)或者合同要求;中國締結(jié)或者參加的國際條約、協(xié)定有特殊要求的,還應(yīng)當(dāng)符合國際條約、協(xié)定的要求。

進(jìn)口國家(地區(qū))暫無標(biāo)準(zhǔn),合同也未作要求,且中國締結(jié)或者參加的國際條約、協(xié)定無相關(guān)要求的,出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)保證其出口食品符合中國食品安全國家標(biāo)準(zhǔn)。

Article 38 Producers of export food should guarantee that the export food shall comply with the requirements stipulated in the standards of the importing country (region) or contracts. The requirements in the international treaties and protocols shall also be followed if there are any special clauses in such treaties and protocols entered into or acceded to by China Under the circumstances that standards in the importing country (region) are unavailable or there are no such requirements in the contracts, and there are no relevant requirements stipulated in international treaties and protocols entered into or acceded by China , producers of export food should guarantee that the export food shall comply with Chinese national standards on food safety.


第三十九條 海關(guān)依法對出口食品實(shí)施監(jiān)督管理。出口食品監(jiān)督管理措施包括:出口食品原料種植養(yǎng)殖場備案、出口食品生產(chǎn)企業(yè)備案、企業(yè)核查、單證審核、現(xiàn)場查驗(yàn)、監(jiān)督抽檢、口岸

抽查、境外通報(bào)核查以及各項(xiàng)的組合。

Article 39 The Customs Administration shall, in accordance with the law, implement supervision and management on export food. Measures for supervision and management on export food include: recordation of plantations and farms for raw materials of export food , recordation of producers of export food, verification of enterprises, review of documentation, inspection on site, supervision and sampling inspection, inspection at port, notice to foreign countries for verification and a combination thereof.


第四十條 出口食品原料種植、養(yǎng)殖場應(yīng)當(dāng)向所在地海關(guān)備案。海關(guān)總署統(tǒng)一公布原料種植、養(yǎng)殖場備案名單,備案程序和要求由海關(guān)總署制定。

Article 40 The plantations and farms for raw materials of export food shall submit their record to the local Customs Administration,. General Administration of Customs should uniformly make public a recordation list of the plantations and farms for raw materials, and the relevant recordation procedures and requirements shall be formulated by the General Administration of Customs.


第四十一條 海關(guān)依法采取資料審查、現(xiàn)場檢查、企業(yè)核查等方式,對備案原料種植、養(yǎng)殖場進(jìn)行監(jiān)督。

Article 41 The Customs Administration shall, by law, supervise the recorded plantations and farms for raw materials by such means as review of documentation, inspection on site and verification of enterprises.


第四十二條 出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)向住所地海關(guān)備案,備案程序和要求由海關(guān)總署制定。

Article 42 Producers of export food shall submit their record to the local the Customs Administration, and the recordation procedures and requirements shall be formulated by the General Administration of Customs.


第四十三條 境外國家(地區(qū))對中國輸往該國家(地區(qū))的出口食品生產(chǎn)企業(yè)實(shí)施注冊管理且要求海關(guān)總署推薦的,出口食品生產(chǎn)企業(yè)須向住所地海關(guān)提出申請,住所地海關(guān)進(jìn)行初核后

報(bào)海關(guān)總署。海關(guān)總署結(jié)合企業(yè)信用、監(jiān)督管理以及住所地海關(guān)初核情況組織開展對外推薦注冊工作,對外推薦注冊程序和要求由海關(guān)總署制定。

Article 43 In case that a foreign country (region) requires registration of Chinese producers of export food to export food to its country (region) and requests recommendation from the General Administration of Customs, such producers must file an application to the Customs Administration in their domicile, which should preliminarily review the application and then report to the General Administration of Customs. The General Administration of Customs shall, based on the enterprises’ credit, supervision and management, and results of preliminary review by the Customs Administration in their domicile, organize and carry out the external recommendation registration, whose procedures and requirements shall be formulated by General Administration of Customs.


第四十四條 出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)建立完善可追溯的食品安全衛(wèi)生控制體系,保證食品安全衛(wèi)生控制體系有效運(yùn)行,確保出口食品生產(chǎn)、加工、貯存過程持續(xù)符合中國相關(guān)法律法規(guī)、

出口食品生產(chǎn)企業(yè)安全衛(wèi)生要求;進(jìn)口國家(地區(qū))相關(guān)法律法規(guī)和相關(guān)國際條約、協(xié)定有特殊要求的,還應(yīng)當(dāng)符合相關(guān)要求。

出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)建立供應(yīng)商評估制度、進(jìn)貨查驗(yàn)記錄制度、生產(chǎn)記錄檔案制度、出廠檢驗(yàn)記錄制度、出口食品追溯制度和不合格食品處置制度。相關(guān)記錄應(yīng)當(dāng)真實(shí)有效,保存期限不

得少于食品保質(zhì)期期滿后6 個月;沒有明確保質(zhì)期的,保存期限不得少于2 年。

Article 44 Producers of export food should set up a complete and traceable control system for food safety and sanitation, guarantee the effective functioning of the same and ensure that the export food is produced, processed and stored in consistent compliance with Chinese laws and regulations and requirements of safety and sanitation on producers for export food. For any special requirements in the relevant laws and regulations of an importing country (region) as well as international treaties and agreements, the corresponding requirements shall have to be fulfilled. Producers of export food shall set up such systems as suppliers assessment, incoming

inspection records, production record archiving, ex-factory inspection records, export food tracings and non-conforming food disposal. Relevant records shall be true and valid and be kept for at least 6 months from the expiration date of the food or for at least 2 years for unavailability of explicit expiration date.


第四十五條 出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)保證出口食品包裝和運(yùn)輸方式符合食品安全要求

Article 45 Producers of export food shall guarantee that the export food is packaged and transported according to the food safety requirements.


第四十六條 出口食品生產(chǎn)企業(yè)應(yīng)當(dāng)在運(yùn)輸包裝上標(biāo)注生產(chǎn)企業(yè)備案號、產(chǎn)品品名、生產(chǎn)批號和生產(chǎn)日期。進(jìn)口國家(地區(qū))或者合同有特殊要求的,在保證產(chǎn)品可追溯的前提下,經(jīng)直屬海關(guān)同意,出口食品生產(chǎn)企業(yè)可以調(diào)整前款規(guī)定的標(biāo)注項(xiàng)

Article 46 Producers of export food shall indicate on their transportation packages the record number of producer, name of product, batch number and date of manufacture. In case of special requirements stipulated by the importing country (region) or in the contract, the producers of export food, on the premise of guaranteeing that the products are traceable and with approval obtained from the Customs Administration directly under the General Administration, may modify the information indicated on the packages as mentioned in the preceding article.


第四十七條 海關(guān)應(yīng)當(dāng)對轄區(qū)內(nèi)出口食品生產(chǎn)企業(yè)的食品安全衛(wèi)生控制體系運(yùn)行情況進(jìn)行監(jiān)督檢查。監(jiān)督檢查包括日常監(jiān)督檢查和年度監(jiān)督檢查。

監(jiān)督檢查可以采取資料審查、現(xiàn)場檢查、企業(yè)核查等方式,并可以與出口食品境外通報(bào)核查、監(jiān)督抽檢、現(xiàn)場查驗(yàn)等工作結(jié)合開展。

Article 47 The Customs Administration shall, within its jurisdiction, supervise and inspect the operation of control system for food safety and sanitation by producers of export food, including routine supervision and inspection as well as annual supervision and inspection. For supervision and inspection, review of documentation, inspection on site and audit of enterprises may be adopted, along with export food overseas notice for review, supervision, sampling inspection, inspection on site, etc .


第四十八條 出口食品應(yīng)當(dāng)依法由產(chǎn)地海關(guān)實(shí)施檢驗(yàn)檢疫。海關(guān)總署根據(jù)便利對外貿(mào)易和出口食品檢驗(yàn)檢疫工作需要,可以指定其他地點(diǎn)實(shí)施檢驗(yàn)檢疫。

Article 48 Inspection and quarantine on the export food shall be implemented by the  Customs Administration in the place of origin by law. The General Administration of Customs may, based on facilitation of foreign trade and the inspection and quarantine requirements for export food, designate other sites for inspection and quarantine.


第四十九條 出口食品生產(chǎn)企業(yè)、出口商應(yīng)當(dāng)按照法律、行政法規(guī)和海關(guān)總署規(guī)定,向產(chǎn)地或者組貨地海關(guān)提出出口申報(bào)前監(jiān)管申請。產(chǎn)地或者組貨地海關(guān)受理食品出口申報(bào)前監(jiān)管申請后,依法對需要實(shí)施檢驗(yàn)檢疫的出口食品實(shí)施現(xiàn)場檢查和監(jiān)督抽檢。

Article 49 Producers and exporters of export food shall, in accordance with the law, administrative regulations and the provisions stipulated by the General Administration of Customs, submit an application to the Customs Administration in the place of origin or place of consolidation for supervision before declaration for export. The Customs Administration in the place of origin or place of consolidation, upon accepting  such application, shall, by law, conduct inspection on site, supervision and sampling inspection on the export food subject to inspection and quarantine.


第五十條 海關(guān)制定年度國家出口食品安全監(jiān)督抽檢計(jì)劃并組織實(shí)施。

Article 50 The Customs Administration shall formulate an annual national schedule for supervision and sampling inspection on export food safety, and organize its implementation. 


第五十一條 出口食品經(jīng)海關(guān)現(xiàn)場檢查和監(jiān)督抽檢符合要求的,由海關(guān)出具證書,準(zhǔn)予出口。進(jìn)口國家(地區(qū))對證書形式和內(nèi)容要求有變化的,經(jīng)海關(guān)總署同意可以對證書形式和內(nèi)容

進(jìn)行變更。出口食品經(jīng)海關(guān)現(xiàn)場檢查和監(jiān)督抽檢不符合要求的,由海關(guān)書面通知出口商或者其代理人。相關(guān)出口食品可以進(jìn)行技術(shù)處理,的,經(jīng)技術(shù)處理合格后方準(zhǔn)出口;不能進(jìn)行技術(shù)處理或者經(jīng)技術(shù)處理仍不合格的,不準(zhǔn)出口。

Article 51 For the export food that has met the requirements through on-site inspection, supervision and sampling inspection, the Customs Administration shall issue relevant certificates and permit it to be exported. In case there is a change in the form and content of such certificates required by an importing country (region), modifications may be made accordingly provided that approval is obtained from the General Administration of Customs. The Customs Administration shall give a written notice to exporters or agents for any non-conformity of export food found during inspection on site, supervision and sampling inspection. Such food can still be permitted to export after having met relevant requirements through technical treatment, and such food that cannot be treated technically or still fails to meet relevant requirements after technical treatment is not permitted to export.


第五十二條 食品出口商或者其代理人出口食品時應(yīng)當(dāng)依法向海關(guān)如實(shí)申報(bào)。

Article 52 When exporting any food, exporters or agents shall, by law, make a truthful declaration to the Customs Administration. 


第五十三條 海關(guān)對出口食品在口岸實(shí)施查驗(yàn),查驗(yàn)不合格的,不準(zhǔn)出口。

Article 53 The Customs Administration shall check the export food at port, which shall not be permitted to export if found to be non-conforming upon inspection.



第五十四條 出口食品因安全問題被國際組織、境外政府機(jī)構(gòu)通報(bào)的,海關(guān)總署應(yīng)當(dāng)組織開展核查,并根據(jù)需要實(shí)施調(diào)整監(jiān)督抽檢比例、要求食品出口商逐批向海關(guān)提交有資質(zhì)的檢驗(yàn)機(jī)構(gòu)

出具的檢驗(yàn)報(bào)告、撤回向境外官方主管機(jī)構(gòu)的注冊推薦等控制措施。

Article 54 For export food with safety issues notified by international organizations and foreign governments, the General Administration of Customs shall organize the verification, and, based on necessity, adjust the proportion of supervision and sampling inspection, order the food exporters to submit, by batches, inspection reports issued by accredited test agencies to the Customs Administration, withdraw the recommendation of registration in foreign official competent authorities and take other control measures of the same nature.


第五十五條 出口食品存在安全問題,已經(jīng)或者可能對人體健康和生命安全造成損害的,出口食品生產(chǎn)經(jīng)營者應(yīng)當(dāng)立即采取相應(yīng)措施,避免和減少損害發(fā)生,并向所在地海關(guān)報(bào)告。

Article 55 For export food with safety issues that have already impaired or may impair human health and life safety, producers of export food should immediately take corresponding measures to avoid and minimize such impairment and file a report to the local Customs Administration.


第五十六條 海關(guān)在實(shí)施出口食品監(jiān)督管理時發(fā)現(xiàn)安全問題的,應(yīng)當(dāng)向同級政府和上一級政府食品安全主管部門通報(bào)。

Article 56 The Customs Administration, for any safety issues discovered during supervision and management on the export food, should notify the competent authorities of the government both at the same and the superior level for food safety . 


Chapter IV Supervision and Management

第四章 監(jiān)督管理


第五十七條 海關(guān)總署依照《食品安全法》第一百條規(guī)定,收集、匯總進(jìn)出口食品安全信息,建立進(jìn)出口食品安全信息管理制度。

各級海關(guān)負(fù)責(zé)本轄區(qū)內(nèi)以及上級海關(guān)指定的進(jìn)出口食品安全信息的收集和整理工作,并按照有關(guān)規(guī)定通報(bào)本轄區(qū)地方政府、相關(guān)部門、機(jī)構(gòu)和企業(yè)。通報(bào)信息涉及其他地區(qū)的,應(yīng)當(dāng)同

時通報(bào)相關(guān)地區(qū)海關(guān)。海關(guān)收集、匯總的進(jìn)出口食品安全信息,除《食品安全法》第一百條規(guī)定內(nèi)容外,還包括境外食品技術(shù)性貿(mào)易措施信息。

Article 57 The General Administration of Customs, based on Article 100 of the Food Safety Law, collects and summarizes the safety information about import and export food, and sets up a safety information management system for import and export food. The Customs Administrations at all levels take charge of collecting and sorting out the safety information about import and export food within their jurisdictions and designated by the Customs Administration at the superior level, and, based on relevant provisions, notify the local governments, relevant authorities, institutions and enterprises in their jurisdictions. In case that the information notified involves other regions, a notice should be given also to the Customs Administration in relevant regions. In addition to the contents required by Article 100 of the Food Safety Law, the safety information about import and export food collected and summarized by the Customs Administration should also include the information about technical measures to trade food in foreign countries.


第五十八條 海關(guān)應(yīng)當(dāng)對收集到的進(jìn)出口食品安全信息開展風(fēng)險(xiǎn)研判,依據(jù)風(fēng)險(xiǎn)研判結(jié)果,確定相應(yīng)的控制措施。

Article 58 The Customs Administration should conduct risk research and judgment on the collected safety information about the import and export food, and, based on the relevant results,determine the corresponding control measures. 


第五十九條 境內(nèi)外發(fā)生食品安全事件或者疫情疫病可能影響到進(jìn)出口食品安全的,或者在進(jìn)出口食品中發(fā)現(xiàn)嚴(yán)重食品安全問題的,直屬海關(guān)應(yīng)當(dāng)及時上報(bào)海關(guān)總署;海關(guān)總署根據(jù)情況

進(jìn)行風(fēng)險(xiǎn)預(yù)警,在海關(guān)系統(tǒng)內(nèi)發(fā)布風(fēng)險(xiǎn)警示通報(bào),并向國務(wù)院食品安全監(jiān)督管理、衛(wèi)生行政、農(nóng)業(yè)行政部門通報(bào),必要時向消費(fèi)者發(fā)布風(fēng)險(xiǎn)警示通告。

海關(guān)總署發(fā)布風(fēng)險(xiǎn)警示通報(bào)的,應(yīng)當(dāng)根據(jù)風(fēng)險(xiǎn)警示通報(bào)要求對進(jìn)出口食品采取本辦法第三十四條、第三十五條、第三十六條和第五十四條規(guī)定的控制措施。

Article 59 In case of an outbreak of food safety incidents or epidemics at home and abroad that may affect import and export food safety, or any serious food safety issues discovered in the import and export food, the Customs Administration directly under the General Administration should immediately file a report to the General Administration of Customs. The General Administration of Customs shall, depending on the developments, release a risk alert, render a risk warning notice within the system of the Customs Administration, notify the department of the State Council responsible for food safety supervision and management, health administrative and agricultural administrative departments, and, if necessary, give a risk warning notice to consumers. For the import and export food with a risk warning notice given by the General Administration of Customs, the control measures stipulated in Article 34, Article 35, Article 36 and Article 54 of these Measures shall be taken according to the requirements specified in the risk warning notice. 


第六十條 海關(guān)制定年度國家進(jìn)出口食品安全風(fēng)險(xiǎn)監(jiān)測計(jì)劃,系統(tǒng)和持續(xù)收集進(jìn)出口食品中食源性疾病、食品污染和有害因素的監(jiān)測數(shù)據(jù)及相關(guān)信息。

Article 60 The Customs Administration formulates an annual national schedule to monitor safety risks in import and export food, and collect monitoring data and relevant information related to food-borne diseases, food contamination and harmful factors in the import and export food in a systematic and consistent manner.


第六十一條 境外發(fā)生的食品安全事件可能對中國境內(nèi)造成影響,或者評估后認(rèn)為存在不可控風(fēng)險(xiǎn)的,海關(guān)總署可以參照國際通行做法,直接在海關(guān)系統(tǒng)內(nèi)發(fā)布風(fēng)險(xiǎn)預(yù)警通報(bào)或者向消費(fèi)

者發(fā)布風(fēng)險(xiǎn)預(yù)警通告,并采取本辦法第三十四條、第三十五條和第三十六條規(guī)定的控制措施。

Article 61 In case of an outbreak of food safety incidents in foreign countries that may affect the food within the territory of China or uncontrollable risks believed to be existing after an assessment, the General Administration of Customs may, with reference to international practices, directly release the risk warning notice within the system of the Customs Administration or to consumers and take the control measures stipulated in Article 34, Article 35 and Article 36 of these Measures.


第六十二條 海關(guān)制定并組織實(shí)施進(jìn)出口食品安全突發(fā)事件應(yīng)急處置預(yù)案。

Article 62 The Customs Administration formulates and organizes the implementation of contingency plans against emergencies in import and export food safety.


第六十三條 海關(guān)在依法履行進(jìn)出口食品安全監(jiān)督管理職責(zé)時,有權(quán)采取下列措施:

(一)進(jìn)入生產(chǎn)經(jīng)營場所實(shí)施現(xiàn)場檢查;

(二)對生產(chǎn)經(jīng)營的食品進(jìn)行抽樣檢驗(yàn);

(三)查閱、復(fù)制有關(guān)合同、票據(jù)、賬簿以及其他有關(guān)資料;

(四)查封、扣押有證據(jù)證明不符合食品安全國家標(biāo)準(zhǔn)或者有證據(jù)證明存在安全隱患以及違法生產(chǎn)經(jīng)營的食品。

Article 63 The Customs Administration, when,performing by law its duties of supervision and management on import and export food safety, is entitled to take the measures as follows:

(I) Access to the site of production and operation for an on-the-spot inspection;

(II) Conduct sampling inspection on the food produced or managed;

(III) Look up and duplicate relevant contracts, bills, accounting books and other relevant documentation;

(IV) Seal up or detain the food that is evidenced to fail to comply with Chinese national standards on food safety, or evidenced for potential safety hazards and production and operation in violation of laws.


第六十四條 海關(guān)依法對進(jìn)出口企業(yè)實(shí)施信用管理

Article 64 The Customs Administration shall conduct credit management on the importers and exporters by law.



第六十五條 海關(guān)依法對進(jìn)出口食品生產(chǎn)經(jīng)營者以及備案原料種植、養(yǎng)殖場開展稽查、核查。

Article 65 The Customs Administration shall, by law, carry out audit and verification on the producers and operators of import and export food as well as recorded plantations and farms for raw materials.


第六十六條 過境食品應(yīng)當(dāng)符合海關(guān)總署對過境貨物的監(jiān)管要求。過境食品過境期間,未經(jīng)海關(guān)批準(zhǔn),不得開拆包裝或者 卸離運(yùn)輸工具,并應(yīng)當(dāng)在規(guī)定期限內(nèi)運(yùn)輸出境。

Article 66 Transit food shall comply with the requirements of General Administration of  Customs for transit goods. Transit food, in the course of transit, shall not be unpacked or unloaded from transportation means without approval from the Customs Administration, and should be shipped out of the territory by a prescribed deadline.


第六十七條 進(jìn)出口食品生產(chǎn)經(jīng)營者對海關(guān)的檢驗(yàn)結(jié)果有異議的,可以按照進(jìn)出口商品復(fù)驗(yàn)相關(guān)規(guī)定申請復(fù)驗(yàn)。有下列情形之一的,海關(guān)不受理復(fù)驗(yàn):

(一)檢驗(yàn)結(jié)果顯示微生物指標(biāo)超標(biāo)的;

(二)復(fù)驗(yàn)備份樣品超過保質(zhì)期的;

(三)其他原因?qū)е聜浞輼悠窡o法實(shí)現(xiàn)復(fù)驗(yàn)?zāi)康牡摹?/p>

Article 67 Producers and operators of import and export food, with any objections to the inspection results provided by the Customs Administration, may apply for a re-inspection according to provisions on re-inspection of import and export goods. The re-inspection may be rejected by the Customs Administration in any of the following cases:

(I) Test results show microbiological indicators exceed the criteria;

(II) Backup samples for re-inspection have expired;

(III) Re-inspection on backup samples is made impossible due to other reasons.


第五章 法律責(zé)任 Chapter V Legal Liabilities

第六十八條 食品進(jìn)口商備案內(nèi)容發(fā)生變更,未按照規(guī)定向海關(guān)辦理變更手續(xù),情節(jié)嚴(yán)重的,海關(guān)處以警告。食品進(jìn)口商在備案中提供虛假備案信息的,海關(guān)處 1 萬元以下罰款


Article 68 The record of a food importer,has been modified, and the importer has failed to process the change formalities with the Customs AdministTration according to the stipulations, the Customs Administration shall give a warning if the circumstances are serious. Any food importer providing false information in the record shall be imposed a fine less than RMB 10,000 by the Customs Administration.


第六十九條 境內(nèi)進(jìn)出口食品生產(chǎn)經(jīng)營者不配合海關(guān)進(jìn)出口食品安全核查工作,拒絕接受詢問、提供材料,或者答復(fù)內(nèi)容和提供材料與實(shí)際情況不符的,海關(guān)處以警告或者 1 萬元以下罰款。

Article 69 Any producers and operators of import and export food in China that fail to cooperate with the Customs Administration in inspection on import and export food safety, refuse to answer questions and provide materials, or provide the answers and materials that are inconsistent with the actual conditions, shall be warned or imposed a fine less than RMB 10,000 by the Customs Administration.


第七十條 海關(guān)在進(jìn)口預(yù)包裝食品監(jiān)管中,發(fā)現(xiàn)進(jìn)口預(yù)包裝食品未加貼中文標(biāo)簽或者中文標(biāo)簽不符合法律法規(guī)和食品安全國家標(biāo)準(zhǔn),食品進(jìn)口商拒不按照海關(guān)要求實(shí)施銷毀、退運(yùn)或者技

術(shù)處理的,海關(guān)處以警告或者 1 萬元以下罰款。

Article 70 The Customs Administration, upon discovering the Chinese labels unattached to the prepackaged import food, or Chinese labels attached failing to comply with laws, regulations and Chinese national standards on food safety during relevant supervision, and the food importer refuses to destruct, return or technically treat the food according to requirements of the Customs Administration, shall give the food importer a warning or impose a fine less than RMB 10,000 ..


第七十一條 未經(jīng)海關(guān)允許,將進(jìn)口食品提離海關(guān)指定或者認(rèn)可的場所的,海關(guān)責(zé)令改正,并處 1 萬元以下罰款

Article 71 For the import food moved away from the place designated or approved by the Customs Administration without its permission, the Customs Administration shall give an order for correction, and impose a fine less than RMB 10,000 .


第七十二條 下列違法行為屬于《食品安全法》第一百二十九條第一款第三項(xiàng)規(guī)定的“未遵守本法的規(guī)定出口食品”的,由海關(guān)依照《食品安全法》第一百二十四條的規(guī)定給予處罰:

(一)擅自調(diào)換經(jīng)海關(guān)監(jiān)督抽檢并已出具證單的出口食品的;

(二)出口摻雜摻假、以假充真、以次充好的食品或者以不合格出口食品冒充合格出口食品的;

(三)出口未獲得備案出口食品生產(chǎn)企業(yè)生產(chǎn)的食品的;

(四)向有注冊要求的國家(地區(qū))出口未獲得注冊出口食品生產(chǎn)企業(yè)生產(chǎn)食品的或者出口已獲得注冊出口食品生產(chǎn)企業(yè)生產(chǎn)的注冊范圍外食品的;

(五)出口食品生產(chǎn)企業(yè)生產(chǎn)的出口食品未按照規(guī)定使用備案種植、養(yǎng)殖場原料的;

(六)出口食品生產(chǎn)經(jīng)營者有《食品安全法》第一百二十三條、第一百二十四條、第一百二十五條、第一百二十六條規(guī)定情形,且出口食品不符合進(jìn)口國家(地區(qū))要求的。

Article 72 For the following violations belonging to "failure to comply with these Measures to export food" as stipulated in the third subparagraph, the first paragraph, Article 129 of the Food Safety Law, the Customs Administration shall, based on Article 124 of the Food Safety Law, render a punishment:

(I) Changing without authorization the export food that has been supervised and sampled for inspection by the Customs Administration with certificates issued;

(II) Exporting the food that is adulterated, deceiving or misleading and shoddy, and replacing the conforming export food with non-conforming one;

(III) Exporting the food that is produced by producers of export food that have not yet been put on record;

(IV) Exporting the food that is produced by unregistered producers of export food to the country (region) with requirements for registration, or exporting the food that is produced beyond the range of registration of registered producers of export food;

(V) The export food produced by producers of export food fails to use, according to the stipulations, the raw materials from plantations and farms that are put on record;

(VI) Producers and operators of export food fall under the circumstances in Article 123, Article 124, Article 125 and Article 126 of the Food Safety Law, and the export food fails to comply with requirements in the importing country (region).


第七十三條 違反本辦法規(guī)定,構(gòu)成犯罪的,依法追究刑事責(zé)任。

Article 73 Anyone, violating these Measures and constituting a crime, shall be investigated for criminal responsibility by law.


第六章 附 則 Chapter VI Supplementary Provisions


第七十四條 海關(guān)特殊監(jiān)管區(qū)域、保稅監(jiān)管場所、市場采購、邊境小額貿(mào)易和邊民互市貿(mào)易進(jìn)出口食品安全監(jiān)督管理,按照海關(guān)總署有關(guān)規(guī)定執(zhí)行。

Article 74 For supervision and management on the import and export food safety in the customs special supervision areas, bonded supervision zones, market purchase and small-scale border trades and fairs among the inhabitants of border areas, the relevant provisions stipulated by the General Administration of Customs shall be followed. 


第七十五條 郵寄、快件、跨境電子商務(wù)零售和旅客攜帶方式進(jìn)出口食品安全監(jiān)督管理,按照海關(guān)總署有關(guān)規(guī)定辦理。

Article 75 For supervision and management on the import and export food safety involving e-mail, express mail, cross-border e-commerce retail and passengers carrying, the relevant provisions stipulated by the General Administration of Customs shall be followed.


第七十六條 樣品、禮品、贈品、展示品、援助等非貿(mào)易性的食品,免稅經(jīng)營的食品,外國駐中國使領(lǐng)館及其人員進(jìn)出境公用、自用的食品,駐外使領(lǐng)館及其人員公用、自用的食品,中國

企業(yè)駐外人員自用的食品的監(jiān)督管理,按照海關(guān)總署有關(guān)規(guī)定辦理。

Article 76 For non-traded foods such as sample, gift, present, exhibit and aid, duty-free foods, foods for public or personal use by foreign embassies and consulates in China and personnel thereof to cross border, foods for public or personal use by Chinese embassies and consulates in foreign countries and personnel thereof, and foods for personal use by personnel of Chinese enterprises in foreign countries, the relevant provisions stipulated by General Administration of Customs shall be followed.


第七十七條 本辦法所稱進(jìn)出口食品生產(chǎn)經(jīng)營者包括:向中國境內(nèi)出口食品的境外生產(chǎn)企業(yè)、境外出口商或者代理商、食品進(jìn)口商、出口食品生產(chǎn)企業(yè)、出口商以及相關(guān)人員等。

本辦法所稱進(jìn)口食品的境外生產(chǎn)企業(yè)包括向中國出口食品的境外生產(chǎn)、加工、貯存企業(yè)等。

本辦法所稱進(jìn)口食品的進(jìn)出口商包括向中國出口食品的境外出口商或者代理商、食品進(jìn)口商。

Article 77 The producers and operators of import and export food as referred to in these Measures include foreign producers, foreign exporters or agents that export food to China, and food importers, producers of export food, exporters and relevant personnel thereof. The foreign producers of import food as referred to in these Measures include foreign enterprises engaged in production, processing and storage of export food to China. The importers and exporters of import food as referred to in these Measures include foreign exporters or agents, and food importers that export food to China.


第七十八條 本辦法由海關(guān)總署負(fù)責(zé)解釋。

Article 78 The interpretation of these Measures shall be vested in the General Administration of Customs.


Article 79 These measures shall come into force as of January 1, 2022. The Measures for the Administration of Import and Export Food Safety promulgated in the form of Decree No. 144 by the former General Administration of Quality Supervision, Inspection and Quarantine on September 13, 2011 and amended in accordance with Decree No. 184 of the former General Administration of Quality Supervision, Inspection and Quarantine on October 18, 2016 and Decree No. 243 of the General Administration of Customs on November 23, 2018,

the Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Meat Products promulgated in the form of Decree No. 136 by the forme  General Administration of Quality Supervision, Inspection and Quarantine on January 4, 2011 and amended in accordance with Decree No. 243 of the General Administration of Customs on November 23, 2018, 

《進(jìn)出口肉類產(chǎn)品檢驗(yàn)檢疫監(jiān)督管理辦法》,原國家質(zhì)量監(jiān)督檢驗(yàn)檢疫總局于2011年1月4日以第136號令形式頒布,并根據(jù)海關(guān)總署2018年11月23日第243號令修訂,

the Measures for the Supervision and Administration of Inspection and Quarantine of Imported and Exported Dairy Products promulgated in the form of Decree No. 152 by the former General Administration of Quality Supervision, Inspection and Quarantine on January 24, 2013,and amended in accordance with Decree No. 243 of the General Administration of Customs on November 23, 2018 and the Provisions on the Administration of Filing of Export Food Production Enterprises promulgated in the form of Decree No. 192 of the former General.

進(jìn)出口乳制品檢驗(yàn)檢疫監(jiān)督管理辦法》原國家質(zhì)量監(jiān)督檢驗(yàn)檢疫總局于2013年1月24日以第152號令的形式頒布,并于11月23日根據(jù)海關(guān)總署第243號令修訂,2018年和原總局令第192號頒布的《出口食品生產(chǎn)企業(yè)備案管理規(guī)定》


Administration of Quality Supervision, Inspection and Quarantine on November 14, 2017 and amended in accordance with Decree No. 243 of the General Administration of Customs on November 23, 2018 shall be abolished simultaneously.

2017年11月14日根據(jù)海關(guān)總署令第243號于2018年11月23日修訂的國家質(zhì)量監(jiān)督檢驗(yàn)檢疫局同時廢止。
